What you agree to when you use Whisperly.

These terms cover your use of Whisperly, a Mac app that turns speech into clean text. By using Whisperly you agree to them. Whisperly is operated by Evgeny Alexeev, a sole proprietor registered in Uzbekistan (support@whisperly.io).
Using Whisperly
Whisperly is for turning your own speech into text. Do not use it to break the law, to abuse the service or other people, to record or transcribe another person without their consent, or to overload, attack, or reverse-engineer it.
Who can use Whisperly
By using Whisperly you confirm that you are at least 16 years old, or at least the age at which your country lets you consent to digital services on your own if that is lower, and that if you are under 18 you have a parent's or guardian's permission. We do not ask for your age and we do not verify it; this is your promise to us.
Your account
You sign in with a one-time code sent to your email. Keep access to that inbox secure. You are responsible for what happens under your account.
Plans and billing
Whisperly has a Free plan and a Pro plan. Pro is $14 per month, billed monthly. There is no annual plan. New accounts start with 14 days of full Pro at no cost and with no card (one free trial per person).
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all Whisperly orders. Paddle takes the payment, charges any tax that applies, and is the seller of record for your subscription. Paddle's buyer terms apply to the purchase alongside these terms.
You can cancel any time. Cancellation stops future renewals and you keep Pro until the period you paid for ends. Refunds follow our Refund Policy.
Your content and ours
Whisperly, the app, the service, and everything that makes them work are ours. What you say, and the text Whisperly produces from it, are yours. You give us permission to process your audio and text only to produce your result: it goes to the providers named in our Privacy Policy, your text comes back, and we keep none of it. We do not store your audio and we do not train models on your content.
The service is provided as is
Whisperly is provided “as is” and “as available”. We make no promise that it works for any particular purpose, that it is free of defects, or that it does not step on anyone's rights, and to the extent the law allows we give no other warranties. The service can change or be unavailable from time to time. Speech-to-text and the cleanup that follows can mishear you or change the meaning of what you said: review the output before you rely on it.
Limits on our liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of profit, revenue, data, or goodwill, arising from your use of the service. Our total liability to you for any direct loss is capped at the fees you paid for Whisperly in the 12 months before the event giving rise to the claim. This cap and these exclusions do not apply to loss caused by intent or gross negligence, or to any liability that cannot be limited by law. Your mandatory local consumer rights still apply.
If your use causes a claim against us
If your misuse of the service, your content, or your breach of these terms or the law brings a claim from someone else against us, you cover our reasonable costs of dealing with it. If you are a consumer, this applies only to the extent your local law allows.
Ending your account
You can stop using Whisperly at any time and delete your account from the app. We may suspend or end an account at our discretion if you breach these terms, if your use risks harm to the service or other people, or after long inactivity. If we end an account for breach, fees already paid are not refunded; otherwise refunds follow our Refund Policy.
The rest of the fine print
These terms, together with the policies they link to, are the entire agreement between us. If any part of them is found invalid, the rest still stands. If we do not enforce a clause once, that does not mean we give it up. We may transfer these terms as part of the business; you may not transfer your account or these terms to someone else. We are not responsible for failures caused by events outside our reasonable control.
Changes
We may update these terms. We will update this page and the date above, and we will try to flag a significant change.
Governing law
These terms are governed by the laws of Uzbekistan. Your mandatory local consumer rights still apply.
